Acceptable Use Policy
Last updated: May 2025
1. Overview
This Acceptable Use Policy ("AUP") governs the use of all services provided by PingRack, including VPS, dedicated servers, managed hosting, and colocation services. This AUP is incorporated by reference into your Terms of Service agreement with PingRack.
The purpose of this AUP is to protect the integrity and reliability of our network, ensure the security of our customers and third parties, and ensure compliance with applicable Indian and international laws. By using PingRack services, you agree to comply with this AUP at all times.
PingRack reserves the right to update this AUP at any time. Changes will be effective upon posting to our website. Continued use of our services after any such changes shall constitute acceptance of the updated AUP. If you disagree with this policy, you must immediately stop using our services.
2. Prohibited Activities
The following activities are strictly prohibited on PingRack infrastructure. This list is not exhaustive — PingRack reserves the right to determine, in its sole discretion, whether any activity violates the spirit of this policy.
- Spam & Unsolicited Email: Sending bulk unsolicited email, operating open mail relays, harvesting email addresses, or any form of email abuse.
- Illegal Content: Hosting, distributing, or linking to content that is illegal under Indian law or the laws of your jurisdiction, including CSAM, pirated software, and counterfeit goods.
- DDoS Attacks: Launching distributed denial-of-service attacks, participating in botnets, or using our infrastructure to amplify or coordinate network attacks against any target.
- Phishing & Fraud: Operating phishing sites, credential harvesting pages, fake login portals, or any site designed to deceive users into divulging sensitive information.
- Malware Distribution: Hosting, distributing, or facilitating the spread of viruses, trojans, ransomware, spyware, or any other malicious code.
- Port Scanning & Hacking: Conducting unauthorised port scans, vulnerability probes, or hacking attempts against systems you do not own or have explicit permission to test.
- Tor Exit Nodes: Operating Tor exit nodes or anonymous proxy services designed to obscure illegal activity.
- Cryptocurrency Mining (Unauthorised): Mining cryptocurrency without prior written approval from PingRack — due to the excessive resource consumption involved.
- Copyright Infringement: Hosting torrent sites, illegal streaming services, or any platform primarily facilitating copyright infringement.
- Network Abuse: Generating excessive bandwidth in a manner that disrupts other customers or our network infrastructure, IP spoofing, or ARP poisoning.
3. Resource Limits
Each service plan includes specific resource allocations (CPU, RAM, storage, bandwidth). You are expected to operate within these allocations. Sustained CPU usage above your allocated vCPU share on VPS plans, or bandwidth consumption that exceeds your monthly allocation, may result in temporary throttling or additional charges.
If your workload consistently exceeds your plan's resources, we will contact you to discuss upgrading to a more suitable plan. We do not bill for bandwidth overages without prior notification — when you approach your limit, we will alert you so you can upgrade before any restriction is applied.
Resource-intensive activities such as large-scale video transcoding, bulk email delivery (for legitimate purposes), or high-traffic web services must be discussed with our team in advance. We are happy to accommodate demanding workloads with appropriate plan configurations.
4. Enforcement
PingRack actively monitors our network for traffic patterns and activities that may violate this AUP. We use automated systems and manual review to detect abuse. Upon identifying a potential violation, we will:
- Issue a warning and request immediate remediation for first-time, non-severe violations.
- Immediately suspend services for severe violations (DDoS attacks, malware hosting, illegal content) without prior notice.
- Permanently terminate accounts for repeated or serious violations, with no refund.
- Report illegal activities to law enforcement as required or appropriate.
Emergency suspensions (without prior notice) are reserved for situations where continued operation poses an immediate risk to our network, other customers, or third parties. We will notify you of the reason for suspension as soon as practicable.
Account termination due to AUP violations does not entitle you to any refund. PingRack shall not be liable for any damages arising from service suspension or termination due to AUP violations.
5. Reporting Abuse
If you observe any activity on PingRack infrastructure that you believe violates this AUP — including spam, phishing, DDoS, or illegal content — please report it promptly to our abuse team. We take all reports seriously and investigate every legitimate complaint.
To report abuse, send an email to [email protected] with as much detail as possible, including the offending IP address, date and time of the incident, description of the activity, and any supporting logs or screenshots. We will acknowledge your report within 24 hours and provide an update within 48 hours.
For urgent matters such as active DDoS attacks originating from our network, please contact our emergency NOC line available 24/7. We are committed to maintaining a clean, responsible network and appreciate the community's help in identifying abuse.
